What is missed-call text-back (and is it legal)?
Missed-call text-back is a phone feature that sends an automatic text to someone right after their call to your business goes unanswered, so they can reply by text instead of calling someone else. It can be legal when the text is a plain reply to their call that names your business, follows texting hours and honors STOP, but the rules aren't fully settled, so a missed call is not permission to send marketing.

- It saves calls you'd lose. A caller who hears voicemail may just call the next business.
- Keep the first text a reply, not a pitch. "Sorry we missed your call, how can we help?"
- Follow texting hours: 9am to 8pm in the caller's time zone, not before noon on Sundays.
- Register your number with the carriers (A2P 10DLC) or texts may be blocked.
- This page is not legal advice. Ask a lawyer about your exact setup.
How it works
- Someone calls your business number.
- Nobody picks up, or the call goes to voicemail.
- Your phone system or CRM sees the missed call and sends a text from your business number within seconds.
- The caller replies. The conversation shows up in your inbox, app or CRM, where your team can answer.
- If they want to book, you send a link or a time. If they want a call back, you call.
It works with a mobile or office number, as long as your provider can send texts from it. Many landline numbers can be "text-enabled" through a texting provider. It's one piece of fast follow-up; see what is speed to lead?
What the text should say
Short, plain and about their call:
- "Hi, it's [Business]. Sorry we missed your call! How can we help? Reply here or book a time: [link]. Reply STOP to opt out."
- After hours, send this at 9am instead: "Good morning, it's [Business]. We missed your call last night. Still need help? Reply here. Reply STOP to opt out."

Is missed-call text-back legal?
Often it can be, if it's set up with care. But no law has a clear exception for it, so here are the basics to understand.
The federal law is the TCPA. The FCC treats texts as calls under it. FCC rules say telemarketing calls made with an autodialer or a prerecorded or artificial voice need the person's "prior express written consent," and sales calls can't be made before 8am or after 9pm local time (47 CFR 64.1200). In 2021, the Supreme Court narrowed what counts as an "autodialer" (Facebook v. Duguid), but that didn't end the risk, because state laws and other rules still apply.
Returning a missed call isn't clearly covered either way. In 2025, a federal court in Utah held that a business returning a missed call wasn't making an unsolicited call, because the person had called first. That case was about a phone call, not a text, and one court's ruling isn't binding elsewhere. A TCPA lawyer writing about it noted the rules have no exception for "returning a missed call" (TCPAWorld, July 2025).
State laws can be stricter. Florida limits sales calls and texts to 8am–8pm and three per 24 hours about the same matter (Foley & Lardner, 2021). Texas brought marketing texts under its telemarketing law in September 2025, with no texts before noon on Sundays (Mailchimp summary).
STOP has to work. Federal rules require honoring an opt-out within 10 business days, and a 2026 FCC order lets businesses name set opt-out methods, like replying STOP, if they're clearly shown in each text (DLA Piper, October 2026). Honor it right away.
AI voice callbacks need consent. The FCC ruled in 2024 that AI-generated voices count as "artificial" voices under the TCPA (FCC, February 2024). So an AI calling people back needs their consent first.
How to lower your risk
- Send one text that answers their call. No offers, no coupons.
- Name your business and include "Reply STOP to opt out."
- Hold texts outside 9am–8pm in the caller's time zone, and before noon on Sundays.
- If they reply, help them. If they don't, stop. Only add them to follow-up or marketing texts if they agree.
- Add a consent line to your web forms for people who want texts.
- Keep records: the call, the text and any opt-out.
Setup options
| Option | Good for | Watch out for |
|---|---|---|
| Built into a CRM (for example GoHighLevel) | Businesses that also want booking, reminders and lead follow-up in one place | Monthly cost, plus carrier registration for each business |
| Your business phone system (VoIP) | Teams that mainly want calls and texts in one app | Not every plan includes it; check the text features |
| A standalone texting app | A quick fix for a single location | Another inbox to watch, and texts may not reach your CRM |
| Done for you | Owners who don't want to set it up | Make sure the number and data stay in your name |
Whatever you pick, register your number for business texting (A2P 10DLC). Carriers can block or filter texts from unregistered numbers, so test it after setup by calling yourself and missing the call.
Mistakes to avoid
- Sending a sales pitch as the first text.
- Texting at 11pm because the call came in at 11pm.
- A text that doesn't say who it's from.
- Nobody watching the replies. A text-back only helps if someone answers.
How we set it up
Missed-call text-back is part of our lead follow-up. We write the wording, register your texting number with the carriers and set the hours so texts only go out from 9am to 8pm in the caller's time zone, not before noon on Sundays. It also ties into a booking page so callers can pick a time. See pricing for which plans include it.
Questions
What is missed-call text-back?
An automatic text sent to someone right after their call to your business goes unanswered, so they can reply by text.
Do I need consent to text someone who called me?
The rules don't clearly answer this. A single plain reply about their call is lower risk than marketing. For follow-up or offers, get clear consent first, and ask a lawyer about your setup.
Can I send missed-call texts at night?
Don't. Hold the text until 9am in the caller's time zone, or noon on Sunday. Your voicemail greeting can cover the hours in between.
Does missed-call text-back work with a landline?
Often, yes. Many texting providers can text-enable an existing business number. Ask your phone provider first.
Is it the same as an AI receptionist?
No. Text-back sends a text after a missed call. An AI receptionist answers the call with a voice. AI voice calls to people need their consent first.
